OVERVIEW

Welcome to Wapiti Forged. The terms “we”, “us”, and “our” refer to Wapiti Forged, a Wyoming-based brand offering crafted golf equipment, field-made artifacts, and private fitting experiences. This website and online store are hosted on Shopify Inc., which provides us with the e-commerce platform to offer our products and services (the “Services”) to you.

These Terms of Service (“Terms”) govern your access to and use of the Services. By visiting our site or purchasing from us, you engage in our Service and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you should not use or access the Services.

1. ELIGIBILITY & ACCOUNT SECURITY

By using our Services, you represent that you are at least the age of majority in your state or province of residence. You are responsible for maintaining the confidentiality of your account and password, and for all activities under your account.

2. OUR PRODUCTS

Wapiti Forged offers a range of products, including:

The Ledger: Forged irons available exclusively by invitation or referral, issued in limited quantities and recorded in our private registry.
Artifacts: Small-batch goods made from elkhide, canvas, brass, and other natural materials — crafted to serve a quiet purpose and offered in seasonal drops. Quantities are limited and restocks are not guaranteed.
The Foundry: A private, invitation-only fitting experience in the Black Hills. Appointments are subject to approval and availability.

Product images and descriptions are provided for reference. Due to natural material variation and screen settings, actual product appearance may vary. We reserve the right to discontinue any item or modify descriptions without notice.

3. ORDERING & ACCEPTANCE

All orders are subject to acceptance. Placing an order does not guarantee availability. We reserve the right to limit or cancel quantities and to refuse service at our sole discretion.

Orders are considered accepted only after payment is processed and confirmation is issued. Items offered through The Ledger are available by approval only and may require separate communication for fulfillment.

4. PRICES & PAYMENTS

Prices are shown in U.S. dollars and do not include applicable taxes or shipping fees. We reserve the right to change pricing at any time without notice.

You agree to provide current and complete billing information. Payment must be authorized at the time of purchase. We accept payment methods as listed at checkout.

5. SHIPPING & RETURNS

We ship from Wyoming and do not guarantee delivery dates. Title and risk of loss pass to you upon our delivery to the carrier.

Returns are accepted only under conditions outlined in our Return Policy. For Artifact purchases, quantities are limited and exchanges may not be possible. Items issued through The Ledger or The Foundry may be non-returnable due to customization.

6. INTELLECTUAL PROPERTY

All content on this website — including product names, logos (e.g., the Wapiti crest), design elements, and text — is the property of Wapiti Forged and protected by intellectual property laws. The use of our trademarks, logos, or content without permission is strictly prohibited.

The phrase “Wapiti Forged,” the Wapiti crest, The Ledger, The Foundry, and other product or collection names are trademarks or common law marks of Wapiti Forged.

7. OPTIONAL TOOLS & THIRD-PARTY LINKS

Our store may provide access to third-party tools or content. These are provided “as is” without warranties. We are not responsible for any third-party materials or websites.

8. PRIVACY

Your submission of personal information through the store is governed by our Privacy Policy. Certain personal data may also be subject to Shopify’s privacy practices. By using the Services, you agree to both.

9. FEEDBACK

If you submit comments, reviews, or suggestions (“Feedback”), you grant us a non-exclusive license to use, reproduce, and share that content for business purposes. You represent that your Feedback does not violate any third-party rights.

10. ERRORS & OMISSIONS

We reserve the right to correct errors in pricing, descriptions, or availability without prior notice. We may cancel orders affected by such errors.

You may not use the Services for unlawful or prohibited purposes, including but not limited to copyright infringement, impersonation, or interference with security features. We reserve the right to terminate your access for violations.

12. TERMINATION

We may suspend or terminate your access to the Services at our discretion. Sections that naturally survive termination — such as intellectual property and indemnification — will remain in effect.

13. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Wapiti Forged is not liable for any indirect, incidental, or consequential damages arising from use of the Services or our products.

14. INDEMNIFICATION

You agree to indemnify and hold harmless Wapiti Forged, Shopify, and affiliated parties from any claims arising from your breach of these Terms or your use of the Services.

15. GOVERNING LAW

These Terms are governed by the laws of the State of Wyoming. You consent to the jurisdiction of courts located in Wyoming for any legal proceedings arising out of these Terms.

We reserve the right to update or replace any part of these Terms at our discretion. The most current version will be posted on this page with the date of last revision. Continued use of the Services constitutes acceptance of any changes.
